Welcome to Shivoham Overseas. These Terms and Conditions govern the commercial B2B relationships, export inquiries, quotations, purchase contracts, and deliveries conducted between Shivoham Overseas and our global buyers.

1. Agreement and Scope

By submitting an inquiry, requesting a quote, or issuing a purchase order to Shivoham Overseas, you explicitly agree to comply with and be bound by these Terms and Conditions. These terms supersede any conflicting buyer purchasing conditions unless explicitly agreed otherwise in a signed written contract.

2. Quotations, Pricing, and Validity

Due to fluctuations in commodity markets (such as copper LME rates for brass parts and raw scrap metal indices for steel castings):

  • All export price quotes are valid for a maximum of 15 calendar days from the date of issue unless specified otherwise.
  • Prices are quoted on standard Incoterms 2020 formats: FOB (Free On Board, loading port), CFR (Cost and Freight), or CIF (Cost, Insurance & Freight).
  • Prices exclude import duties, local terminal handling charges (THC), and customs clearance fees at the destination port.

3. Payment Terms

Standard payment terms for international bulk orders are as follows:

  • Telegraphic Transfer (T/T): 30% advance deposit upon order confirmation, and the remaining 70% balance against the scanned copy of shipping documents (including Bill of Lading, Invoice, and Packing List).
  • Letter of Credit (L/C): 100% Irrevocable Letter of Credit at sight, confirmed by a first-class international bank, with all banking fees outside India borne by the buyer.

4. Custom Orders and Tolerances

For high-precision items like brass knurled inserts, flanges, and casting diffusers/impellers:

  • Production begins only after the buyer approves technical blueprint drawings and signs off on pilot samples.
  • Standard manufacturing dimensional tolerances adhere to international norms (e.g. ISO 2768-m) unless custom tolerances are requested.
  • A quantity variance of ±5% is acceptable on custom bulk runs due to foundry and extrusion process limits, with billing adjusted accordingly.

5. Shipping and Force Majeure

Estimated dispatch schedules are provided in good faith. Shivoham Overseas is not liable for transport delays caused by vessel booking rollouts, port congestion, customs clearance audits, or Force Majeure events (natural disasters, war, strikes, pandemics, or trade embargoes).

6. Claims and Dispute Resolution

Any claims regarding quality differences, manufacturing defects, or quantity mismatches must be reported in writing within 15 days of cargo arrival at the destination port. Claims must be accompanied by photos, lab testing reports, or third-party inspection reports (e.g., SGS/TUV). All disputes are subject to the exclusive jurisdiction of the courts of Jamnagar, Gujarat, India.
